What is a GPCB certificate?

GPCB Consent Certificate is a document issued by the Gujarat Pollution Control Board (GPCB) to an industrial unit that has been granted consent to establish and operate. GPCB Registration is a process of registering an industrial unit with the GPCB.

Who Needs a Gujarat Pollution Control Board (GPCB) NOC?

As per the provisions of “The water (Prevention & Control of Pollution) Act, 1974; The Air (Prevention and Control of Pollution) Act, 1981 and Hazardous Wastes (Management, Handling and Transboundary Movement) Rules, 2008” any industry that causes to pollute water bodies by releasing harmful effluents into the sea, releases any kind of industry gas or deals with a unit that manages hazardous waste and indulges in the disposal, transportation, storage or treatment of the same has to mandatorily obtain a Consent to Establish (CTE) or a No Objection Certificate (NOC) before starting such business.

How Are Industries Categorized Under The Gujarat Pollution Control Board (GPCB) Certificate?

The Ministry of Environment, Forestry and Climate Change (MoEFCC) published notices to limit the operation of a number of businesses. To decide where to situate these businesses, industries were divided into Red, Orange, Green, and White categories. Later, the application of this idea was extended to other parts of the country for a number of objectives, such as the control of consent and the development of guidelines for the monitoring and examination of businesses. The primary determinants of categorizing processes have been the scale of the businesses and resource consumption. The possible harm to human health as well as the pollution brought on by the emission of pollutants and effluents were not taken into account. The Pollutant Index, or Pl, of any manufacturing industry is a number ranging from 0 and 100; a rising Pl value denotes a higher pollution load from that sector. The following Range of Pollutant Index guideline for identifying industry sectors has been finalized following the end of many brainstorming meetings involving CPCB, SPCBs, and MoEFCC.
Red Category Industries: Pl ranging from 60 or a higher. This is an area where pollutants and effluents are released at toxic levels. Industries in the red category are not permitted in ecologically sensitive or protected regions.
Orange Category Industries: Pl ranging from 41 to 59. Industries in this area create high level pollution but are considerably lesser than those in the red category.
Green Category Industries: Pl ranging from 21 to 40. Industries do not create pollution to toxic levels but emissions from enterprises are at a moderate level.
White Category Industries: Pl ranging 20 or lower. Industries create low to no pollution under this category. It is not mandatory for industries under the white category to obtain a NOC.

What Consent Is Required Under The Gujarat Pollution Control Board (GPCB)?

Every industry before and at the time of establishment of industries are required to obtain the following consent.

Consent to Establish (CTE): Needs to be obtained before an enterprise has started its operations. It is mandatory for any establishment to apply for a CTE before any operation or function has taken place in an organization. With the aid of the National Informatics Centre (NIC), Gandhinagar, the Government of Gujarat has launched a portal called XGN- extended Green Node so it’s easy for an application to be submitted online as per the provisions of Environmental Laws. Following are the steps to apply for CTE.

Consent to Operate Consolidated Consents and Authorization (CCA): Such consent is required to be applied for at the start of any business operation.After the establishment of essential machinery or system required for the control of pollution and at the start of the business activity, a CCA shall be applied for in accordance with the laws under the Water Act, Air Act and the Hazardous Waste Rules.Once a CCA receipt is issued, the concerned authority shall install an Environment Management System (EMS) for the purpose of containing and controlling pollution.
After rigorous scrutiny by the legal and technical authorities, a CCA shall then be issued to the applicant that consists of various terms and conditions including the need to maintain standards.
